These Terms of Service will form the agreement between you and Bodog for your use on this website www.bodog.com. For the purposes of these Terms of Service, 'Bodog' shall mean both:

-Connaught Media BV: the licensed company registered in Curaçao with registered company number 145098 whose registered office is at Kaya Richard J. Beaujon, ZN, PO Box 6248, Curaçao with license issued by Curaçao eGaming with the license number 1668 / JAZ, and

-Connaught International Limited: the company that manages the payment systems, registered in Malta under registered company number C84367, whose registered office is at the Vision Exchange Building, level 2, Territorials Street, Mriehel, Birkirkara, BKR 3000

Please read these terms and conditions carefully as they contain important information related to your legal rights, solutions and obligations.

2. Legal

2.1 Licenses

You are hereby granted the following non-transferable revocable licenses ("Licenses"):

  1. A license to view, use, print and download content from our Site for personal use only.
  2. A license to upload Postings to the Site for your private and personal use.
  3. A license to download, install and use the Software to play and participate in the Games for your private and personal use.

You acknowledge and agree that:

  1. None of the Licenses are exclusively yours and you may not transfer your rights to anyone else.
  2. We may revoke or terminate any or all of the Licenses and any of the rights thereunder at any time and for any reason.
  3. Upon termination of any of the Licenses you must immediately cease participating and playing in our Games; delete the Software; remove the Publications; and destroy all Content you have downloaded or printed.

Any rights not expressly granted in these Terms are reserved.


2.2 Jurisdiction, Governing Law and Dispute Resolution
  1. These Terms of Use are governed by and construed and otherwise constructed in accordance with the applicable law(s) of Antigua and Barbuda.
  2. Any dispute that may arise in connection with these terms will be referred to the Gaming Commission in accordance with the relevant provision of the Regulations.
  3. If you have any complaints or concerns arising from your use of our Site, including matters relating to material appearing on the Site, please contact soporte@bodog.com immediately, where one of our Customer Service agents will address your situation. If your concern cannot be resolved to your satisfaction by our Customer Care agent, you may request in writing to soporte@bodog.com that the request be escalated to our Customer Care Supervisor.
  4. Although we prefer to deal with disputes internally in accordance with the above procedures, you may also refer your situation to the Gaming Commission, which can be contacted at: complaints@curacao-egaming.com.

2.3 Express Acknowledgements

By accessing and/or using the services available on the Site, you expressly acknowledge and agree that:

  1. You have voluntarily sought out and made contact with the site;
  2. For the purposes of placing any wager or other transaction, you are deemed to have attended Curaçao;
  3. Any transaction conducted by you through the Site shall be deemed to have taken place in Curaçao, and shall be conducted and covered in accordance with the laws applicable in Curaçao, without regard to any conflict of law provisions. any claim, dispute or controversy which may arise out of or in connection with or relating to this agreement, or the breach or alleged breach hereof, shall be submitted to arbitration to the Curaçao egaming licensing authority under the trade rules in effect for such association, except as expressly provided herein. All proceedings shall be held with a transcribed copy in english. Each party shall select an arbitrator within 30 days of receiving notice of intent to arbitrate. Within 15 days of receipt of the notice of intent to arbitrate, the two arbitrators shall select a third neutral arbitrator to act as presiding arbitrator. If no arbitrator is appointed within the time limits or following a mutually agreed extension of time, the association shall make an appointment within fifteen days of such failure. The amount signified by the arbitrators shall include the costs of arbitration, reasonable attorneys' fees, and reasonable costs for experts and other witnesses. deliberation for such amount shall enter into any court having jurisdiction, provided, however, that nothing in this section shall be deemed to prevent entry into court as necessary to protect our name, proprietary information, trade secrets, business knowledge or any other appropriate provision or equitable remedy.
  4. The aforementioned arbitration proceedings shall be conducted in the forum of Antigua and Barbuda, who shall have exclusive jurisdiction with respect to any and all disputes that may arise hereunder, and no legal action or claim of any nature whatsoever may be brought in any other jurisdiction; and
  5. You are solely responsible for confirming and ensuring compliance with any local prohibitions and/or regulations that may be applicable to your activities on the Site, including those of your country or jurisdiction of residence.
  6. You are solely responsible for any and all local taxes or other amounts payable in your country of residence, or related to your winnings or withdrawals made in connection with your account.

2.4 Intellectual Property Rights
  1. You acknowledge us as the licensee of all Intellectual Property Rights in the Site, the Content, Software and the Games. These works are protected by intellectual property laws and treaties around the world. All rights are reserved. For purposes of these Terms, "Intellectual Property Rights" means patent rights (including patent applications and disclosures), copyrights (including copyright applications), trade secrets, moral rights, marketing know-how and any other similar rights or intangible property recognized under any international law(s) or convention(s) in any country or jurisdiction in the world where the rights are recognized.
  2. You may print off one copy, and may download extracts, of any page(s) from the Site for your personal reference, and you may draw the attention of others to material on the website.
  3. You acknowledge that you have no right to access source code, decode code or comments in the Software.
  4. The integrity of the Software is covered by technical protection measures ("TPM") so that intellectual property rights, including copyrights, in the Software are not appropriated by anyone other than you. You may not in any way attempt to remove or intercede with the TPM, or apply or manufacture for sale or hire, import, distribute, sell or lease, offer or display for sale, advertise for sale or hire or have in your possession for private or commercial purposes any means whose sole purpose is to facilitate the unauthorized removal or interception of the TPM.
  5. We reserve the right to remove any or all Content, Software and Games from the Site (in particular but not limited to if we suspect that they infringe the intellectual property rights of another).
  6. Subject to these Terms, you do not acquire any rights in the Site, Content, Services or Software. You may not (and shall not be permitted, and shall not enable any other person to) copy, modify, create a derivative work or engineer, decompile or otherwise attempt to extract the source code of the Software, or any part thereof, unless expressly permitted or required by law, or unless you have been specifically authorized by us in writing.
  7. You agree that you may not remove, obscure or alter any proprietary rights notices (including logos and copyright laws) that may be affixed to, contained in or displayed on the Site, Software or Services. Unless you have entered into a written agreement with us, nothing in these Terms entitles you to use Bodog's brand names, logos, services, trademarks, domain names and/or any other distinctive elements. Unless expressly authorized in writing, you expressly agree not to use Bodog's trademark, logo, brand name, service mark, or any other distinctive element or any other element that may intentionally create confusion about the owner or authorized user of such marks, names and logos.

GDPL STATEMENT

Having come into effect on September 18th, 2020 – The General Data Protection Law (GDPL) sets new standards and regulatory/compliance requirements for every company that holds or processes personal data. Its primary aim is to allow individuals greater control over their personal data and strengthening the rights of those within Brazil.

Bodog formally states that it will execute and achieve all GDPL requirements needed to be aligned with legal requirements.

3.1 Scope

Bodog has established the following three main areas of focus in order to be aligned with GDPL directives:

  1. Enhancing already established continuity management programs, processes and procedures in order to be compliant with GDPL requirements;
  2. Provide clear and transparent information on how personal data is gathered legally, making sure it is protected from misuse and exploitation;
  3. Provisions in assisting customers to better comprehend how to access their personal data and offer an easier way in opting in or out their details from mailing lists – while ensuring GDPL compliance.

Whether it be through industry-leading and security-certified infrastructure providers or high-level security data centers that successfully uphold the confidentiality of data and stored information - Bodog is committed in providing its customers with a variety of solutions and offerings to support GDPL obligations – which include but not limited to:

  1. Ongoing and continuous monitoring of logged information;
  2. Prompt reporting to the relevant supervisory body if there has been the unlikely event of a data breach;
  3. Encrypted data protection through the use of operating equipment in accordance with GDPL standards;
  4. Account management practices that greatly assist in mitigating any potential risk or breach.

3.2 How do we protect your information

Bodog takes the security and privacy of your information to the upmost of importance and seriousness. Industry-standard security methods are used to ensure the safeguard of the information and data we collect. Once gathered, your information is stored securely and is restricted to only authorized individuals for access. Security measures in place include (but not limited to):

    1. Continuous monitoring or auditing of processes;
    2. Encrypted data when needed;
    3. Cyber security assessments for the prevention of potential cyber-attacks;
    4. Ongoing staff training regarding relevant security and privacy issues;
    5. Reasonable technical and organizational precautions implemented to prevent the loss, misuse or manipulation of stored information.

3.3 Your rights when you give your information

While Bodog has your information securely stored – you are entitled to the following:

  1. You are entitled to correct and/or change information we have about you (we may request documentation as evidence depending on the request made);
  2. You are entitled to request a copy of certain information that we have about you;
  3. You are entitled to request the information we have about you to be transferred to another organization (we may request specific reasons depending on the request made);
  4. You are entitled to request removal from any or all marketing or distribution lists;
  5. You are entitled to request information we have about you to be removed and/or erased.

If for any reason Bodog cannot fulfill any or all of the requests made by you, a communication will be provided with an explanation.


3.4 Declaration

The new General Data Protection Law strengthens the rights that residents of Brazil have over their data. As such, Bodog recognizes that information and data laws are continuously evolving and will be subject to requirements and frameworks that are more robust.

Bodog has not only invested in resources in order to be compliant with GDPL measures, we will continuously update and oversee data protection developments and measures to ensure that our processes and procedures are always up-to-date according to standards.


4. Obligaciones

4.1 Your obligations

Except as expressly stated in these Terms and Conditions, or as otherwise inconsistent with applicable law, you must

  1. Not copy or reproduce the Content, Software or Games in any manner or for any reason except with our prior permission or where such copies or reproductions are incidental to the normal use of the Content, Software, Games and consistent with the terms of the relevant License;
  2. Note make alterations, modifications, or derivative creations, use all or any part of the Content, Software, and Games, or permit the Content, Software, and Games or any part thereof to be combined with or incorporated into other content, software, or games;
  3. Copy, reproduce, store or include any Content, Software, or Games on any other public or private removal site or system, without our prior consent;
  4. In the event that you have printed or downloaded any Content in accordance with the terms of use to which you agreed: not to use any such illustrations, photographs, images, video or audio sequences, or graphics separately or in conjunction with text; and to ensure that our trademark, legal notices, legends, demonstrations and designs appear on all copies and reproductions;
  5. Not to rent, assign, sub-license, lend, translate, remix, adapt, vary or modify the Software;
  6. Not to disassemble, decompile, decode or create derivative works based on part or all of the Software, or attempt to do so;
  7. Not to provide or make available the Software (in whole or in part, including but not limited to program listings, program source and object listings, object codes and source codes);
  8. Not to use the Software, participate in, or play the Games over any communication network, or through remote access, except as expressly permitted in the Terms;
  9. Not to use any Content, Software or Games for commercial purposes without obtaining a license from our licensors; and
  10. Immediately notify us by email at soporte@bodog.com if you suspect that the Content, Software or any Publication infringes the intellectual property rights of another person.

4.2 Our liability

Nothing in these terms shall exclude or limit our warranty or liability for losses that may be legally excluded or limited by applicable law. Some jurisdictions do not allow the exclusion of certain warranties or conditions or the limitation or exclusion of liability for loss or damage caused by negligence, breach of contract or tort. Accordingly, only the limitations that are lawful in your jurisdiction will apply to you and our liability will be limited to the maximum extent permitted by law. You expressly understand and agree that access to the site and use of the services is at your sole risk, and that the services are provided on an "as is" and "as available" basis.

In particular, we and our subsidiaries, affiliates, service providers and licensors do not represent or warrant to you that:

  1. Your use of the site or services will meet your requirements.
  2. Your use of the site or services will be uninterrupted, fast, secure or error-free.
  3. Any information obtained by you as a result of your use of the site or services will be accurate or reliable.
  4. That defects in the operation or functionality of any software provided as part of the services will be corrected. Any material downloaded or otherwise obtained through the use of the Site or the Services is done at your sole discretion and risk, and you will be solely responsible for any damage to your electronic device or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from us or through the site or the services shall create any warranty not expressly stated in the terms. We hereby expressly disclaim all warranties and conditions of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

 

You understand and expressly agree that we, our subsidiaries and affiliates, and suppliers, and licensors are not liable to you for:

  1. Any direct, indirect, incidental, special, consequential or exemplary damages that may be incurred to you, however caused and under any theory of liability. This includes but is not limited to any loss of money (whether incurred directly or indirectly), any loss of goodwill or business reputation, any loss of data suffered, costs of procuring or replacing goods or services, or other intangible loss.
  2. Any loss or damage which has occurred to you, including but not limited to damage to the goods or services, or other intangible loss.
  3. Any changes we may make to the site or the services, or for temporary or permanent cessation in the provision of the services (or any element within the services).
  4. The deletion, or corruption of, or failure to store any content and other communications data maintained or transmitted by or through the use of the services.
  5. Your failure to provide us with accurate account information.
  6. Your failure to keep your password or account details secure and confidential.
  7. The limitation of our liability described above will apply whether or not you are advised of the possibility of any of these losses occurring.

Without limiting any provision herein, you understand that by using the Services you may be exposed to Content that you may find offensive or objectionable and that, in that regard, your access to the Site and use of the Services is at your own risk.


4.3 Information About You and Your Visits to the Site
  1. We process information about you in accordance with our privacy policy. By using the Site, you consent to such processing and you warrant that all information provided by you is accurate and complete.
  2. By accepting any winnings, prizes or tournament fees, to the fullest extent permitted by law, you grant our affiliates, suppliers and licensors and licensees a perpetual, worldwide, non-exclusive, irrevocable, royalty-free license to use your name and digital and/or electronic or similar image, and any biographical information about you, and to reproduce, modify, adapt, publish, publicly and digitally perform, translate, create derivative works and distribute such materials or incorporate such materials in any form, media or technology known or to be known throughout the world, and the right to copy, broadcast, distribute, incorporate and otherwise use the material for any and all commercial and non-commercial purposes.
  3. You represent to release and hold harmless us and our associates, service providers, licensors, licensees, licensees, affiliates, successors and assigns from any claims, causes of action, remedies and/or damages that may arise from the use of your rights pursuant to the previous clause.
  4. All sessions in the Casino area that remain open for more than 30 days will be closed as of the 30th day.

4.4 Viruses, hacks and other offenses
  1. You may not misuse the Site by knowingly introducing viruses, Trojan, worms, logic bombs or other material that is malicious or technologically harmful. You may not attempt to gain unauthorized access to the Site, the servers on which the Site is stored, computers or databases connected to the Site. You may not attack the Site through a denial-of-service attack or a distributed denial-of-service attack. By breaching these provisions, you are committing a criminal offense. We will report any such breach to the appropriate governmental authority, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately and you will be blocked from all amounts accrued in the Account in settlement of damages incurred as a result of the attack.
  2. We will not be liable for any loss or damage caused by a denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any site to which you have been referred.
  3. You may not:
    1. Use robot software, EPAs or any program designed to simulate game play or to give you an unfair advantage over other players. We will take reasonable steps to ensure that such programs or software are detected;
    2. Discuss or attempt to discuss any aspect of a hand during a Game.
    3. Exchange any information about cards dealt to you during a Game; or;
    4. Engaging in any way in a gambling syndicate or colluding with other players for a specific Game or the Site.
  4. We conduct ongoing monitoring and take rigorous manual and automated game examinations in order to detect this type of behavior and any player who violates these rules will be banned from using the Site for life.

4.5 Publications
  1. When you make use of a feature that allows you to upload posts or other material to the Site, or to make contact with other users of the Site, you must comply with the content standards set and communicated by us from time to time. You warrant that any such contribution you make will comply with those standards, and you will indemnify us for any breach of that warranty.
  2. Other than identification of personal information that is covered by our Privacy Policy, any Postings or other material you may upload to the Site may be considered non-confidential and non-proprietary, and you hereby grant us an irrevocable, worldwide, non-exclusive license to use, copy, distribute and disseminate or license to third parties any such material for that purpose in perpetuity. You represent and warrant to us that you are the legal owner of all content and material submitted to us or uploaded for use on the Site as Postings and that you have the authorization and/or have obtained all necessary consents, permissions and authorizations necessary to grant us such license under this clause.
  3. We will not be liable to any third party for the content or accuracy of any Posting or other material made or uploaded by you or any other user of the Site.
  4. We have the right to remove any Posting or other material made or uploaded by you at our sole discretion.
  5. You are prohibited from making or uploading any Posting or other material to the Site or from transmitting or distributing to, from or on the Site any Posting or Content:
    1. Which is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, likely to incite racial hatred, discriminatory, threatening, scandalous, inflammatory, blasphemous, in breach of confidentiality, in breach of privacy or which may cause any annoyance or inconvenience; or
    2. For which you do not have all necessary licenses and/or approvals; or
    3. Which constitutes or encourages conduct that would be considered a criminal offense, give rise to civil liability, or otherwise be contrary to law or infringe the rights of a third party, anywhere in the world, including, but not limited to, Intellectual Property Rights; or
    4. Which is technically harmful (including but not limited to computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data and other malicious software or harmful data; or
    5. Containing any advertising, promotion, solicitation of goods, services or money, or solicitation of others to become members of any company or organization. You may not make or upload any Postings or other material to the Site anonymously. We do not warrant that we have reviewed or will monitor content, materials, information, documents, postings, graphics and images (including but not limited to messages, data, information, text or links) made available on or uploaded to the Site by others, and we reserve the right to remove any at any time, for any reason. We expressly disclaim any liability for this.

5. Responsible Gambling

  1. Underage access and play is prohibited. Without limiting any other provision herein, and in the interests of transparency, under no circumstances may an Account be created by a user under the legal age of eighteen (18), nor is anyone under the age of eighteen (18) permitted to play. Any Account winnings that are identified by us as improper or used by a minor will be blocked and the Account will be closed.
  2. Recreational activity. The Site and services are created solely for recreational, entertainment purposes. We are committed to ensuring that players have the ability to manage or limit their gambling on the Site. If gambling is negatively affecting professional or personal life, please refer to the resources available here for advice or assistance.
  3. Self-Managed Control Limits. We maintain processes for managing your deposits on the Website, you may request at any time the history of your deposits and withdrawals on the Website, and we will send you the current information available on our Website. Any kind of increase in the deposit or withdrawal limit will depend on the approval of our Finance Team and must be consulted through our Chat.
  4. Account Closure due to Gambling Problems. You have the option to deactivate your account if you think you have gambling problems. We will act immediately. When you contact our Customer Service team to request an account closure, you must provide your security details and you must make it clear that you are requesting an account closure due to game issues. This is to ensure that such requests are different from account freeze requests. If you have requested that your account be closed as a result of realizing that you may or do have problems with the game, your account will be permanently closed, with no possibility of reactivation.
  5. Temporarily set the limit to zero / "Cool down". You have the option to temporarily deactivate the account for any reason and request that it be reopened for the period specified in your request. This request must be made with our Customer Service team, in which you must state the reason, security details and also the period of your interruption. Deactivations are not definitive and keep your actual balance frozen on your own account, and if there is any active bonus, it may expire during the period your account is frozen, and the reactivated bonus will not be refunded. To reactivate the account, the request must also be made through our Customer Service. If our system detects possible patterns related to betting control, we may discontinue your participation on our website, leaving your account deactivated for a longer period of time or even permanently, depending on our internal analysis. This period will be determined and reported by our Team. The period of time of freezing or permanent closure will allow the player and the website to rethink their participation in the games.
  6. Offensive or defamatory language. We value the good use of the platform and our services, using clear, objective and friendly language in our communications. Bodog will not tolerate inappropriate and offensive language in any means of communication that the player comes into contact with the company, for example, chat, email, phone, etc. Also, you do not have the right to defame Bodog using inside information or even false opinions about any product or service, using any media or external websites. This type of behavior is completely unacceptable, being subject to cancellation or freezing of the account by Bodog, and any future relationship may be interrupted. If we detect the use of offensive language in our communications or the player is defaming the brand or service provided by Bodog, we reserve the right not to compensate or refund any amount upon cancellation / freezing the account.

6. Integrity of the game and wagering

6.1 Fraud
  1. Criminal Activity. If we have reasonable cause to believe that criminal or suspicious activity is taking place through one or more Accounts (including, but not limited to suspicions of attempted money laundering or fraud), we expressly reserve the right to close such Accounts and/or report the activity to the Gaming Commission and/or any other regulatory entity or service. All Account balances (including deposits and any winnings) will be blocked, which may be subject to cancellation without any refund or return of balance.
  2. Fraudulent Activity. If, in our reasonable discretion, we determine that a player is engaged in fraudulent, illegal, dishonest or improper activity (including, but not limited to, the use of a VPN, proxy or similar service that masks or manipulates the identification of your actual location, or by providing false or misleading information, or by placing bets or Poker plays through third parties, or on behalf of a third party) we reserve the right to immediately terminate or deny a player's access to his or her Account. In any event, all Account balances (including both deposits and winnings) will be blocked and we reserve the right to disclose information (including the player's identity) to involved parties including, but not limited to: the Gaming Commission, banks, credit card companies and/or any person or entity that has the legal right to such information, and/or take legal action against that player. If the account is blocked or cancelled, all winnings in the account are subject to final cancellation, without any refund or refund of the current or deposited balance.
  3. No player assistance programs shall be used. The use of any external player assistance programs ("EPA and HUD Programs") that are designed to provide players with an unfair advantage over their opponents are expressly prohibited. EPA Programs include computer software and databases or profiles (e.g., websites and subscription services) and we consider "unfair" access to or the ability to obtain data or information from other players by any way that would not be accessible by your first-hand experience (e.g., observation of playing style). We reserve the right to close Accounts and void all winnings generated by such Accounts if established, in our reasonable discretion, and the use of any program not authorized by Bodog.
  4. "Bots" Prohibited. All actions on the Site must be performed by players through the user interface provided by us. We will take reasonable steps to ensure that all software bots or programs designed to simulate the play of a real player can be detected and prevented from accessing the Site. Any Accounts associated with such activity may be subject to review and possible termination. If, in our reasonable discretion, we determine that an Account is employing such software, the Account will be disabled and all Account balances (including deposits and any winnings) will be blocked.

6.2 Conspiracy and Abuse
  1. Recreational activity. Any player who attempts to gain an advantage by exchanging information or who attempts to take unfair advantage of association with other players will be permanently banned from the Site. If, in our reasonable discretion, we determine that such activity is taking place, accounts may be disabled and all account balances (including deposits and winnings) will be blocked. In addition, all account balances are subject to cancellation and final termination, without any refund or return. Strict scrutiny of manual and automatic matches will be used to detect this type of behavior and will be monitored at all times. We will investigate all player related complaints and will proactively and randomly review these games and accounts. The conspiracy includes Sports, Poker and Casino, any type of collusion detected in one of our products may suffer penalties and accounts associated with this group of players may be banned from playing on our platform.
  2. Chip Dumping. Specifically in Poker, we can characterize "chip dumping" when: we detect the exchange of information about cards, actions that include discussing a hand during the game (in internal or external chat), several players using the same account, deliberately playing smoothly against an opponent, transferring coins or chips. This type of collusion is strictly prohibited and we may cancel accounts associated with chip dumping without making any refund.
  3. Balance or chip transfers between players are prohibited. In accordance with our Anti-Money Laundering policies and protocols, we do not allow money transfers between Player Accounts. Players who transfer money (including the Poker technique called "chip dumping") may have the transfer reversed at our absolute discretion. In such a case, Accounts may be closed and all Account balances (both deposits and any winnings) may be blocked.
  4. Gambling Syndicates". May be characterized as a player or group of players who collaborate in some way (also known as a "syndicate") to receive winnings or real money bonuses on multiple accounts. It is expressly forbidden to have multiple accounts, each player can only have one account. If we detect that the same group or player is placing multiple bets on the same market or line, Bodog has the right to cancel such bets and void any possible winnings. Identical bets are prohibited and also betting in a coordinated manner between multiple users, such actions are prohibited and violate the site's Sports betting limit policy. We have the right to block significant bets placed in an attempt to defraud the house, regardless of whether it was done by a single player or in conjunction with other players or other bookmakers. We reserve the right to close accounts and void all winnings generated by these accounts if applicable and not refund the balance.
  5. Integrity of the sport. We are committed to ensure sports integrity and to participate in all efforts to identify and eradicate match fixing. As such, pursuant to the terms of this Agreement, and any provision of the Privacy Policy, by placing a wager on the Site, you expressly acknowledge and agree that we will reserve in our sole discretion in all cases the option to report all Irregular Betting Activity to sports federations, regulators, agencies, commissions or associations (or their respective agents) as we deem appropriate ("regulatory bodies") in order to enable the identification of irregular activity and to support appropriate investigations.
  6. Irregular Gambling Activity. Means any action that, in our sole discretion, deviates from expected wagering patterns and includes, without limitation: (i) an unusual number of wagers originating from the same geographic region or through linked Accounts; (ii) a bettor continues to place wagers at any price facing a large reduction in the stability of applicable odds; and/or (iii) any other indicator or pattern noted by us as indicative of potential match fixing. We will use reasonable commercial measures to ensure that any information provided by Regulatory Bodies for this matter is subject to reasonable contractual non-disclosure clauses, and all information or documentation shall be destroyed by such Regulatory Bodies when it is no longer relevant or in connection with any ongoing investigation, or disciplinary process.
  7. Abuse of System Vulnerability. If, in our reasonable discretion, we determine that an Account seeks to or has in fact exploited any error, malfunction, bug or other software or hardware vulnerability, we will immediately close the Account and all balances (including deposits and any winnings) will be blocked. If, in our reasonable discretion, we determine that such activity is occurring, the Account(s) may be disabled and all balances (including deposits and any winnings) will be blocked. In that event, we expressly reserve the right to initiate legal action and report the activities to criminal investigative authorities, as appropriate.
  8. Abuse of bonus programs. Bonus programs are created for recreational users only. Professional players or players deemed in our sole discretion to be abusing the bonus system in any way may have their bonus revoked and be subject to other sanctions. Bonus abuse can be defined as (but not limited to) customers cashing out solely for the purpose of re-depositing, depositing over an existing balance, recommending new accounts that they themselves use, or creating accounts in the name of third parties for the purpose of obtaining bonuses. Access through multiple accounts used by one or more persons to enjoy in an organized, indiscriminate and advantageous manner the bonuses granted by the site is prohibited. The bonus is unique and exclusive to each user and must be used for entertainment purposes.   9. Malfunction, human or system error. We reserve the right to void any winnings earned as a result of malfunction or human error. In the event that a malfunction or error is found, all wagers will be void. We can classify the exploitation of human or system errors as: exploitation of blatant errors in odds/probabilities, constant acquisition of odds/probabilities that are considered '' incorrect '' or '' delayed '' by the Sports Team, any vulnerability found in the system limit established by the company to take advantage of sports betting. All these behaviors can be sanctioned by reducing the account closure limits in special cases. If an internal error is detected, any possible winnings will not be taken into account, only the bet will be refunded, thus reversing any damage to the player.
  10. Unfinished games. If your game round is disrupted or closed, all game information, placed bets and incomplete Casino games will remain active until you reopen the game. Unresolved placed bets and incomplete Casino games will be declared void after 60 days and will be voided.
  11. Recreational activity. This site is not associated with or sponsored by the National Football League, the National Basketball League, the National Hockey League, Major League Baseball or any of the team members of these leagues.
  12. Availability of Action. You know that the betting market changes all the time and that odds may increase, decrease or even become unavailable. That is why, depending on the market in which you wish to take action, you should confirm your action for as long as possible, including placing a single system bet, a combination bet, or confirming a cashout. If you are unable to complete a desired action on your bet, Bodog is not responsible for not completing your order.
  13. Required Tools. The player is responsible for having the necessary and satisfactory software, hardware and Internet connection/stability to be able to play correctly on our website or software. If we detect that the player has only had some inconvenience in our platform, no compensation will be obligatory. Also, in such cases no possible winnings will be taken into account. The player also fully understands that he/she is responsible for being able to use the website and software correctly and that he/she is responsible for any damage he/she may have if he/she is unable to complete any action he/she would like to if he/she experiences inconveniences in his/her tools.
  14. Disabled leagues. Bets on leagues that are currently disabled on our site, either by external softwares or by any way that allows to place them when navigation or localization through sports menu is not enabled, will be canceled, even if an outcome has already been determined.

7. Financial

7.1 Deposits, Withdrawals, Refunds and Losses
  1. No balance. Credit will not be extended to any player under any circumstances. You may not play or participate in any activity unless you have deposited sufficient funds into your account. We do not allow accounts to make withdrawals without at least one deposit to the site within the last 30 days.
  2. Deposit Information. To deposit funds into your Account, you must first provide the required information, depending on the payment method chosen for the deposit. Once you have entered such information, you will be able to complete the deposit request from the payment page on your Account ("Deposit Request").
  3. Deposit Hold. If you wish to place any wagers or play in Games, or participate in any tournaments for cash, your money will be deposited and handled by us or a third party provider depending on the outcome of the event in question, Game, or tournament.
  4. Deposit Limits. We reserve the right to place a limit on the amount of funds you are able to deposit at any time in an amount to be determined in our sole discretion. You may request that the deposit limit be altered by contacting our Customer Service.
  5. Acceptance of Deposit. Neither we nor any services offered by our providers are under any obligation to accept a Deposit Request, and we will always notify you in the event a Deposit Request is rejected. If your Deposit Request is accepted, we will ensure that the funds are equivalent to those specified in the Deposit Request and credited to your Account within a reasonable period of time.
  6. Uncollected or Reversed Deposits. If a deposit is reversed or uncollectible for any reason, any winnings generated by play on that Account from the time of the applicable deposit until it is returned or uncollectible will be voided, blocked or deducted from your Account balance. In addition, the amount of the initial failed deposit will be voided, blocked or deducted from your Account balance. In the event that after such deductions, your Account balance is negative, you expressly acknowledge and agree that such negative balance constitutes a debt due and payable to us immediately. You expressly acknowledge and agree that, in the event of non-payment of such debt, we will assign such debt to one or more collection agencies, which shall have the legal right to enforce such debt using all legal means available to them. Note that after assignment of the debt to a collection agency, the resolution of such debt and the legal proceedings associated therewith are not under our control and must be negotiated or settled directly with such collection agency.
  7. Refund. Bodog may authorize the return of a deposit only in exceptional cases. When this happens, a penalty of 30% of the value of the deposit will be charged, due to processing costs. In any case, each case will be analyzed individually, considering the values of the user's account.
  8. Withdrawal.Keep in mind that it will always be necessary to comply with some rules to be able to withdraw your balance, the rules are:
    • To have the balance unblocked (comply with the Rollover of the bonus),
    • If you have deposited without bonus, comply with the Rollover 1x (play 100% of the deposited balance),
    • Have at least 1 (one) deposit in the last 30 days,

    To withdraw funds from your account, you must request it through your account.   1. Payment Processing. Withdrawal methods will be directly related to the form of payment made on deposit. If the account needs to be validated, the deadlines for evaluating the withdrawal will be counted from the approval of the documents received, which were requested by Bodog.
  5. Payment Data. It is the user's responsibility to enter the correct data to process the deposit and withdrawal. This means that when the deposit and withdrawal data is informed, the amount must be paid with this information sent, being impossible to make any kind of refund or cancellation if the data sent is incorrect. This applies to any type of payment method, but mainly to Cryptocurrencies and Bank Transfers.

7.2 Bonus
  1. Bonus Rules. Bodog may make available to its players the following deposit bonus. Each and every bonus will apply the specific rules of this offer, if there is no rule specified in the promotion, the bonus will apply the same Rollover rule as the Welcome Bonus.
  2. Amount of use. All bonuses can only be used once, for bonuses that are available to be used more than once, this option will be explicit in the promotion itself or in its Terms and Conditions.
  3. Expiration. All bonuses have their validity explicitly stated in the Terms and Conditions of the promotion or have the bonus active by logging into your account in the 'Bonuses' section will describe its validity. This expiration period must be respected, as the bonus will only not expire if the player has unlocked the bonus by fulfilling their Rollover requirements within the time limits stated in the promotion. If the bonus has expired, its value cannot be reactivated or even cleared and consequently all winnings obtained will also be cancelled.
  4. Bonus cancellation. All bonuses can be cancelled by the player at any time. This procedure must be carried out by the user in his account in the 'Bonus' and 'Forfeit' sections.

  7. Virtual Sports.No game of Virtual Sports contributes to Rollover compliance. Also, it will not be possible to play with of any bonus in Virtual Sports games.
